The applicant is a Turkish national who was born in 1982 and lives in Istanbul.
The applicant was the editor-in-chief of a periodical entitled “Yeni Evrede Mücadele” (Struggle at the New Phase) at the time of the events giving rise to the application.
The application concerns the criminal proceedings brought against the applicant for disseminating propaganda in favour of Türkiye Komünist Emek Partisi/Leninist (TKEP/L) (Turkish Communist Labour Party/Leninist), an illegal armed organisation, under section 7 § 2 of the Prevention of Terrorism Act (Law no.
3713), on account of certain articles issued in the periodical on different dates.
The applicant was convicted and sentenced to two years and eleven months of imprisonment and a fine of TRY 40,000.
The applicant relies on Article 10 of the Convention.
QUESTION tO THE PARTIES Has there been a violation of the applicant’s right to freedom of expression, protected by Article 10 of the Convention, on account of the criminal proceedings brought against her under section 7 § 2 of the Prevention of Terrorism Act?
The Government are requested to submit all documents relevant to the criminal proceedings brought against the applicant, including a copy of the articles issued in “Yeni Evrede Mücadele” (Struggle at the New Phase) which led to the initiation of the criminal proceedings in question.
